Welcome to ChillMail ("we," "our," or "us"). By using our cold email application ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the App.

4.2. We offer multiple inbox functionality, allowing users to sign into many different email accounts simultaneously and send emails on their behalf.
5. User Obligations and Conduct
5.1. You agree to use ChillMail in compliance with all applicable laws and regulations.
5.2. You will not use ChillMail for any illegal or unauthorized purpose, including but not limited to spam, phishing, or harassment.
5.3. You are solely responsible for the content of emails sent through ChillMail.
6. Intellectual Property Rights
6.1. ChillMail and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2. You retain all rights to the content you submit through ChillMail.
7. Privacy and Data Protection

7.3. We require access to certain information from your Google account to provide our services. We use the following scopes:

7.4. We only store your email address and a link to your public profile picture. We do not store passwords or other sensitive information.
8. Third-Party Services and Content
8.1. ChillMail integrates with Google services. Your use of these services is subject to Google's terms and conditions.
8.2. We are not responsible for any third-party content you access through ChillMail.
9. Billing and Payment
9.1. Fees for using ChillMail, if any, will be clearly communicated to you.
9.2. You agree to pay all fees associated with your use of ChillMail.
9.3. Refunds, if applicable, will be handled on a case-by-case basis.
10. Termination
10.1. You may terminate your account at any time by contacting us.
10.2. We may terminate or suspend your account for any reason, including violation of these Terms.

11. Disclaimer of Warranties
11.1. ChillMail is provided "as is" and "as available" without any warranties of any kind.
11.2. We do not guarantee that ChillMail will be uninterrupted, timely, secure, or error-free.
12. Limitation of Liability
12.1. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use ChillMail.
12.2. Our total liability for any claim arising from or relating to these Terms or ChillMail shall not exceed the amount paid by you, if any, for using ChillMail during the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, liability, or expenses (including attorneys' fees) that arise from your use of ChillMail or violation of these Terms.
14. Governing Law and Dispute Resolution
14.1. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
14.2. In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the matter informally. Both you and ChillMail agree to meet and confer in good faith to attempt to resolve the dispute.
14.3. If the parties are unable to resolve the dispute through informal means within a reasonable time not to exceed thirty (30) days, either party may pursue their available legal remedies.
14.4. Any legal action or proceeding relating to your access to, or use of, ChillMail or these Terms shall be instituted in a state or federal court in Delaware, United States. You and ChillMail agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
14.5. Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of our copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
14.6. To the fullest extent permitted by applicable law, if you are a user outside of the United States, you agree that any dispute between you and ChillMail shall be governed by the laws of the State of Delaware, United States, regardless of principles of conflict of laws.
14.7. YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO CHILLMAIL MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
15. Changes to Terms
15.1. We reserve the right to modify these Terms at any time.
15.2. We will notify you of any changes by sending an email to the address associated with your account.
15.3. Your continued use of ChillMail after any changes to these Terms constitutes acceptance of those changes.
